Legislators would be wise to start over with Marcellus Shale bills

Each chamber of the General Assembly has passed its version of a regulatory bill, but each bill has serious flaws. The legislation under consideration ties the hands of local governments in overseeing gas drilling, lacks meaningful environmental protection and fails to make the drillers pay their fair share of fees and taxes. The Sierra Club urges legislators to start over.

Senate Bill 1100 represents the Senate’s attempt to modernize Pennsylvania’s antiquated Oil and Gas Act by adopting rules for shale gas wells. The Pennsylvania House of Representatives adopted its version in House Bill 1950. Last week, the House voted not to concur with the Senate’s changes to HB 1950, setting the stage for further negotiation.

Both Senate and House bills (SB 1100 and HB 1950) essentially strip local governments of their authority to adopt ordinances to protect their communities. The bills do this by expansively defining all efforts to regulate oil and gas operations as beyond the power of local government. “Oil and gas operations” is broadly defined, and appears to include all aspects of the natural gas drilling and production process, such as seismic testing, well site preparation, well drilling and fracturing, impoundments, compressor stations and processing plants.
